General Statement

AutoHarvest Foundation (AutoHarvest) respects your privacy and created this privacy statement (Privacy Statement) to inform you about the information that AutoHarvest collects, how that information is used and protected, and how you can control your information. In addition to this Privacy Statement, AutoHarvest's Terms and Conditions will also apply to your use of both the Public Website and the Private Member Website, whether you are a Member User or an Independent User.

AutoHarvest Website

AutoHarvest runs and monitors a public website (Public Website) and a private member website (Private Member Website) to foster collaboration within the advanced manufacturing ecosystem. The Public Website contains general, publicly available information about AutoHarvest. The Private Member Website requires a login username and password and provides opportunities for integrated communication, innovation and collaboration between users from industry, government and academia. You can apply for access to the Private Member Website via the Public Website. Any information that you disclose as part of your Private Member Website access application will be governed by the terms of this Privacy Statement.

Consent

By using the Public Website or the Private Member Website, you consent to: (i) the collection and use of the information as described below; and (ii) the terms of this Privacy Statement. If AutoHarvest makes any changes to this Privacy Statement, AutoHarvest will post the updated Privacy Statement on www.autoharvest.org. Such changes will become effective ten (10) days after posting.

Member Users and Independent Users

The Private Member Website is available to two (2) different types of users:

  1. A Member User applies for access to and uses the Private Member Website on behalf of an AutoHarvest member (Member).
  2. An Independent User applies for access to and uses the Private Member Website without an affiliation with a Member.

You should check with your employer to see if your employer is a Member. If you register as a Member User, AutoHarvest will notify a designated Member employee (Organization Administrator) of your registration. The Organization Administrator has the authority to approve or deny your access to the Private Member Website. As a Member User, you are bound by any agreements that you may have entered with the Member that has provided you access to the Private Member Website, including but not limited to an employment agreement, a confidentiality agreement, or an agreement governing use of the Private Member Website (Your Member Agreements). To the extent that a term of this Privacy Statement conflicts with a term contained in Your Member Agreements, the term contained in Your Member Agreements shall prevail. Additionally, the Member may monitor your use of the Private Member Website, view your personally identifiable information (PII), or share your PII with AutoHarvest.

Postings, Messages, Comments and Collaborations

AutoHarvest does not actively monitor the contents of your postings, messages, comments, or collaborations on the Private Member Website (Content), but AutoHarvest has access to and may view Content for legitimate purposes, such as to investigate allegations of inappropriate or illegal activity, or misuse of the Private Member Website. AutoHarvest may make any necessary disclosure of Content to appropriate law enforcement authorities. AutoHarvest may also view Content to assess the functionality of the Private Member Website. AutoHarvest does not review the accuracy of the material included in Content. You hereby release and hold harmless AutoHarvest and its directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with your posting or use of any Content.

Personally Identifiable Information

AutoHarvest may view and may collect PII that you affirmatively provide, including but not limited to:

Use of PII

AutoHarvest will not rent or sell your PII, although AutoHarvest reserves the right to transfer your PII to a surviving entity from a merger, acquisition or similar event. AutoHarvest may share your PII with third parties as required by applicable law or as described herein. If you are a Member User, AutoHarvest may share your PII with that Member, and AutoHarvest may share your PII as required by law, court order, or other governmental authority. If you opt in to use third party software, AutoHarvest may share your PII with such software provider.

By submitting to AutoHarvest any of the PII described above, you agree to release and hold harmless AutoHarvest and its directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use or misuse of your PII.

Aggregate and Non-Personal Information

AutoHarvest uses your Internet Protocol (IP) address to collect certain aggregate and non-personal information when you visit the Public Website or the Private Member Website. Aggregate and non-personal information is not identifiable or specific to you. AutoHarvest will not store your IP address. AutoHarvest uses this information to monitor overall usage of the Public Website and the Private Member Website, such as how many people are using the Public Website and the Private Member Website, and which webpages those people are viewing. Additionally, AutoHarvest may use aggregate and non-personal information to improve the functionality of the Public Website and the Private Member Website, and to enhance your experience.

Google Analytics and Cookies

AutoHarvest also uses Google Analytics to track usage and collect aggregate and non- personal information. Google Analytics uses cookies, which are text files stored on your computer, to analyze how you use the Public Website or the Private Member Website. Additionally, cookies allow you to log on to the Private Member Website without entering your username and password. You may decline the use of cookies by choosing the proper browser setting, but this may affect your ability to fully utilize the Public Website or Private Member Website. Google Analytics also uses your IP address in the course of performing its services, but will not share your IP address information with AutoHarvest. AutoHarvest is not responsible for and does not control the terms of service for Google Analytics, which are currently available at http://www.google.com/analytics/terms/us.html. By using the Public Website or the Private Member Website, you consent to collection and processing of such information by Google Analytics.

Information Retention

Subject to applicable law: (a) AutoHarvest will not delete your user profile after you stop using the Private Member Website, and (b) AutoHarvest retains information, including PII, indefinitely and may use such PII as necessary to comply with legal requirements.

Security

All AutoHarvest employees who have access to, or are associated with, the processing of personal information are contractually obligated to respect the confidentiality of your information and abide by AutoHarvest privacy standards. AutoHarvest stores PII, aggregate and non-personal information in a Tier 1 Data Center with multilayer security which is SSAE 16 certified, but AutoHarvest cannot guarantee that such security will never be compromised. AutoHarvest uses reasonable efforts to ensure the security of information, but as with any data submitted over the Internet, AutoHarvest cannot, and does not, guarantee the absolute security of PII.

Compliance with Laws

AutoHarvest agrees to defend you and hold you harmless from any losses or liability arising from any willful, tortious acts of AutoHarvest, including acts by employees of AutoHarvest acting within the scope of their employment.

Links to Other Sites

The Public Website and Private Member Website provide links to other websites. You should review the privacy practices and privacy statements of those websites. AutoHarvest is not responsible for the privacy practices or privacy statements of other websites.

Receipt of E-mail Communications

You can manage your e-mail preferences or opt out of receiving AutoHarvest e-mail communications at any time. To manage your e-mail preferences or opt out of receiving most AutoHarvest e-mail communications, please adjust the personal settings in your account, or click the opt out link at the bottom of the e-mail.
